Arbitration and Insolvency – who holds the Trump Card?

Members of 20 Essex Street recently hosted an Anniversary lecture at the National Gallery, Singapore. Counsel and arbitrators from 20 Essex Street presented a focused and practical case study exploring the issues encountered by litigators when one of the parties enters an insolvency process.  How does one balance on the tightrope between insolvency proceedings and international arbitration?  What is the impact on third parties ensnared in the web of an insolvent company?  How do courts or tribunals resolve the complex private international law questions that arise?  As instances of insolvency increase, this session provided pragmatic solutions to the issues that inevitably arise.
