Three private healthcare operators brought a successful application to review the Competition Commission’s decision to provide access to confidential material within a disclosure room on unduly restrictive terms, in the context of the ongoing investigation into the private healthcare market. The decision of the Competition Appeal Tribunal made clear that the applicants must be given proper access to data on which the Competition Commission’s Provisional Findings were based in order to be able to respond effectively.
