Michael Collett QC looks at FIMbank plc v KCH Shipping Co Ltd [2020] EWHC 1765 (Comm) and its implications in a recently published article.
In a rare case considering both limbs of section 12(3) of the Arbitration Act 1996 (AA 1996), Mrs Justice Cockerill in the Commercial Court refused the claimant’s application to extend time for commencing ad hoc London arbitration against the respondent, which was made due to the operation of a contractual time bar. The court gave useful guidance on the operation of both limbs of AA 1996, s 12(3).
