On 24 January 2011, Peter Smith J declined to grant Group Lotus summary judgment against 1MRT. He ordered that the full trial be heard on 21 March 2011, shortly after the 2011 Formula 1 season begins. Having acquired an equity stake in the Renault F1 Team in December, the car manufacturer Group Lotus intends to race as Lotus Renault GP, while 1MRT is set to race as Team Lotus with the permission of Team Lotus Ventures. TLV claims that is the successor to the racing business started by Colin Chapman in the 1950s under the name Team Lotus, for which it holds a number of trade mark registrations, but Group Lotus challenges TLV’s rights to use the name. Guy Morpuss QC and Patricia Edwards are representing the Defendants instructed by Macfarlanes (Geoff Steward).
