Monica Feria-Tinta has been instructed to act as legal adviser to draft a proposal for articles of the new Constitution in Chile, on behalf of the Colla Peoples of the Atacama region.
The proposals consist of a number of rights (including some of a collective character) to be discussed in the section concerning fundamental rights under the Constitution. This includes the recognition to the right to a healthy environment as a fundamental right.
In addition, Monica has also been instructed to prepare draft articles and commentaries on the Rights of Nature.
The proposals prepared were submitted on 30 January 2022, with the deadline for submissions being 1 February 2022.
Chile officially started to write a new constitution to replace the one inherited from the dictatorship of Augusto Pinochet, last year after the majority of Chileans voted for a new constitution to be drawn up by a body of elected members, in a referendum.
