On 22 December 2014 the Supreme Court (Lord Neuberger JSC, Lord Clarke JSC and Lord Reed JSC) granted Cargill International SA permission to appeal in The Global Santosh. The Court of Appeal's decision (reported at [2014] 2 Lloyd's Rep 104) was notable for the potentially wide ranging ramifications in the time charter market of the extensive meaning the Court attributed to the phrase "charterers' agents", particularly in the context of vessel arrests. Recent market events have highlighted the importance of the decision, and legal practitioners and market participants alike will doubtless watch the case's progression in the Supreme Court with interest. The appeal is due to be heard by the Supreme Court in early December 2015. Andrew W Baker QC and Daniel Bovensiepen act for the Appellant (instructed by Holman Fenwick Willan LLP).
