Validity and Jurisdiction over Patent
Thomas Raphael QC will review the jurisdictional rules that apply to intellectual property claims, taking into account the consequences of Brexit.

Jurisdiction and justiciability: where are we now for infringement claims in England?
Alexander Thompson will discuss the question of whether the English courts can review the validity of foreign marks and patents in infringement claims, and if so when, including the role of the act of state doctrine and the rule in Moçambique. The talk will focus on key case developments since the Supreme Court’s decision in Lucasfilm v Ainsworth.

Unwired Planet: the beginning of the end of global FRAND rate litigation?

Josephine Davies will consider the impact of the Unwired Planet [2020] UKSC 37 decision. Has the Supreme Court made England the jurisdiction of choice for global FRAND rate setting or has it just encouraged a global race to judgment in FRAND cases? Does the anti-suit injunction have a role to play?
