The London Steam Ship Owners Mutual Insurance Association Ltd v The Kingdom of Spain [2013] EWHC 2840 (Comm)

This case involves disputes between a London P&I Club and the Kingdom of Spain, arising out of the loss of the M/T PRESTIGE in 2002, one of the largest oil spills in recent years. In a judgment handed down on 20 September 2013 the High Court ruled on applications for extensions of time in which to file evidence in response to an application under s.66 Arbitration Act 1996 and to file challenges to the Tribunal’s jurisdiction under s.67/72 of the 1996 Act. The applications involved consideration of the usual Kalmneft criteria but also consideration of the time limits applicable under s.67/72 where the respondent to an award has not participated in the arbitration.
